Building Code Appeal Process

The Virginia Uniform Statewide Building Code provides an administrative process to appeal the final decision of a local Building Official. Any aggrieved party may appeal the Building Official’s/Building Maintenance Official’s decision concerning application of the Virginia Uniform Statewide Building Code (VUSBC) and the Virginia Amusement Device Regulations (VADR) or refusal to grant modification to the provisions of the VUSBC.

Prince William County Building Code Appeals Application

From the date of receipt of the Building Official’s final decision, the applicant shall submit a written request for appeal, indicating specific requirements, to the Prince William County Board of Building Code Appeals within:

  • 30 calendar days for new construction
  • 14 calendar days for building maintenance
  • 14 calendar days for application under the VADR

State Technical Review Board
After final determination by the Prince William County Board of Building Code Appeals, any person who was a party to the appeal may appeal to the State Technical Review Board. Application shall be made to the State Technical Review Board within 21 calendar days of receipt of the decision to be appealed. Failure to submit an application for appeal within the time limit established by this section shall constitute an acceptance of the Prince William County Board of Building Code Appeals resolution or Official's decision.
