DPA2023-00021: 2022 Code of Virginia State Mandated Changes

An amendment to the Prince William County Zoning Ordinance to make changes based on the Virginia General Assembly including Chapter 181 of the Acts of Assembly, and Chapter 249 of the Acts of Assembly.

Background

Every year, the Board reviews the Prince William County Code of Ordinances ("County Code") following the Virginia General Assembly general session, primarily to ensure that the County Code is amended to remain consistent with the Virginia Code given recent legislative changes. The General Assembly has concluded that 2022 year's general session and several Acts of the Assembly necessitate amendments to the County Code, including the Zoning Ordinance. Revisions to the Zoning Ordinance can only be made through the usual process for zoning text amendments that are referred to the County's Planning Commission, and then ultimately to the Board of County Supervisors

On June 28, 2022, the Board of County Supervisors in Res. No. 22-341 initiated an amendment to the Prince William County Code to address the Requirements of enacted Chapters 181 and 249 of the Acts of Assembly enacted during the 2022 General Session. The enactment of Chapter 181 modified language in Virginia Code Section 15.2-2232 to clarify the parks are included within the subject matter of the relevant provision. The enactment of Chapter 249 modified the process by which the Board of County Supervisors is to consider, review, and appropriate funds to the Board of Zoning Appeals

Approval 

On January 16, 2024, the Board of County Supervisors in Ord. No. 24-01 approved the zoning text amendment.
